3 Liability
3.1 XRVAP is only liable for claims for compensation for damages arising from the guarantee of proper performance or from other causes, in particular claims arising from an unlawful act, organizational fault, fault committed at the time of conclusion of the contract or other fault-dependent claims arising from a breach of duty, insofar as XRVAP or its vicarious agents acted with intent or gross negligence. The foregoing exclusion of liability for cases of simple negligence does not apply to damages arising from injury to life, body or health. In such cases, XRVAP is liable even in cases of simple negligence on the part of its legal representatives or vicarious agents.
4 Links to and from other websites
4.1 Hyperlinks from this website to websites belonging to third parties were checked by XRVAP at the time the link was created. Illegal content was not recognizable at the time of linking. XRVAP cannot reasonably be expected to monitor the content of linked websites on an ongoing basis without concrete evidence of a violation of the law. XRVAP will remove such links immediately upon discovery of any legal violations.

5 Jurisdiction and Applicable Law
5.1 To the extent legally permissible, Geneva is the exclusive place of jurisdiction for all disputes arising in connection with this Legal Notice. XRVAP is also entitled to bring legal action at the competent court of the user’s domicile.
5.2 This Legal Notice is subject to Swiss law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
6 Severability clause
6.1 The current or future ineffectiveness of any provision of these Terms of Use shall not affect the legal effectiveness of the remaining provisions. Instead, the ineffective clause will be replaced by a legally effective clause that comes as close as possible to the ineffective clause in spirit and purpose. The same applies in the case of a regulatory loophole.
